LMIA in Canada: Types, Requirements, and Their Influence on Foreign Workers

What is LMIA?

LMIA or labour market impact assessment is a document, which was released by Employment and Social Development Canada (ESDC), evaluates how hiring a foreign worker might affect the job market in Canada. LMIA in Canada is needed to prove that a foreign worker is actually needed to cover a particular job post because no eligible Canadian citizens or permanent residents are available to fill the role.

 

What will be the impact on Foreign Workers?

A positive LMIA is frequently required of foreign employees in order to submit an application for a work visa in Canada. It is proof that the employer has met all the conditions to hire a foreign citizen and that the employment offer is legitimate. Following receipt of a positive LMIA, the foreign employee may apply to Immigration, Refugees and Citizenship Canada (IRCC) for a work permit.

 

Types of LMIA

There are mainly 2 types of LMIA.

  1. LMIA required for low-wage stream: This particular category is intended for foreign-born employees who get hourly wages below the median salary for their province or territory.

  2. LMIA required for high-wage stream: For foreign immigrant workers who earn more than the provincial or territorial median hourly income, this group is especially intended.

 

Requirements by worker:The employee may apply for a work visa after the employer receives the LMIA. A worker needs to apply for a work permit by

  1. job offer letter,

  2. A contract,

  3. A copy of the LMIA, and

  4. The LMIA number


LMIA Application Requirements:

LMIA Applications must include evidence that the following criteria have been met:

  • Business Legitimacy Documents: documents attesting to the employer's legal standing as a Canadian company.

  • Transition Plan: Companies are required to provide a plan outlining how they will handle the requirement to hire foreign workers. Employers are eventually expected to hire permanent residents and citizens of Canada instead of TFWs.

  • Recruitment Efforts: Before hiring a TFW, employers must provide proof that they made significant attempts to find Canadian citizens and permanent residents for the post.

  • Wages: Applications must contain details on the TFW's pay. This will guarantee that TFWs receive the same compensation for their labor as their Canadian counterparts and distinguish high-wage jobs from low-wage roles.

  • Workplace Safety: The same requirements for occupational health and safety apply to TFWs as they do to Canadians in similar positions. Because of this, employers are required to show proof that TFWs will have insurance that at least matches the health benefits provided by the province or territory in which the firm is located.

Can LMIA lead to permanent residency?

A positive LMIA, which certifies that the employer has complied with all laws and regulations, is a positive step, but it does not provide permanent residency. Foreign nationals with skill must still fulfil all conditions for entry through Express Entry.
